The Buckeye Club Subscription Service Agreement

Welcome to The Buckeye Club, a subscription service provided by Buckeye Brownies ("we," "us," or "our"). By subscribing to The Buckeye Club, you ("Subscriber," "Customer," "you," or "your") agree to be bound by the following terms and conditions.

1. Subscription Overview

1.1 Service Description: The Buckeye Club is a monthly subscription service that provides a box containing Limited Edition Flavors curated by Buckeye Brownies. The contents of each box will vary from month to month and will typically be our featured four-pack of brownies released that month.
1.2 Subscription Start Date: Your subscription service begins on the date you successfully complete the payment process and opt in to The Buckeye Club.
1.3 Subscription Cycle: Your subscription will renew automatically on the same day each month as the initial subscription start date ("Billing Date"). You will be charged on the Billing Date each month for your subscription fee.

2. Billing and Payment

2.1 Automatic Billing: By subscribing to The Buckeye Club, you authorize us to charge your provided payment method on a recurring monthly basis on the Billing Date.
2.2 Payment Information: It is your responsibility to keep your billing information up to date. If your payment method is declined or fails for any reason, your subscription will be suspended until the payment issue is resolved. We will notify you and attempt to recharge your payment card within a reasonable timeframe.
2.3 Failed Payments: If a payment is declined or fails, we will notify you via email and attempt to recharge your payment card. If the payment issue is not resolved promptly, your subscription will remain suspended until full payment is made.
2.4 Price Changes: We reserve the right to change the price of the subscription or applicable charges at any time. Any price change will be communicated to you at least 30 days in advance and will apply to subsequent billing cycles.

3. Shipping and Delivery

3.1 Shipping Timeline: Monthly deliveries will be shipped within 4-7 business days after the Customer's payment card is charged on the Billing Date.
3.2 Shipping Costs: Shipping fees are included in the subscription fee unless otherwise specified during the sign-up process. Any exceptions will be communicated clearly before you are charged.
3.3 Shipping Address Changes: If you need to change your shipping address, please update your account information at least 7 days before the next Billing Date to ensure timely delivery.

4. Cancellations, Modifications, and Fees

4.1 Cancellation Policy: You may cancel your subscription at any time by [insert cancellation method, e.g., logging into your account or contacting customer service]. Cancellations must be made at least [X days] before the next Billing Date to avoid being charged for the upcoming month.
4.2 Subscription Modifications: If you wish to modify your subscription (e.g., update payment details, change flavors, or shipping address), you may do so through your account settings on our website. Modifications are subject to availability and must be made before your next Billing Date.

5. Refunds and Returns

5.1 Refund Policy: All sales are final, and we do not offer refunds for delivered products. If you receive a damaged or defective product, please contact us within 1 day for a replacement or resolution.
5.2 Returns: Due to the perishable nature of our products, returns are not accepted.

6. Changes to Subscription Service

6.1 Service Modifications: We reserve the right to modify the contents, pricing, or other terms of The Buckeye Club subscription service. Any significant changes will be communicated to you at least 7 days in advance.
6.2 Customer-Initiated Modifications: You may modify your subscription preferences through your account on our website. This includes updating payment details, shipping addresses, and other preferences.

7. Termination of Subscription

7.1 Company's Right to Terminate: We reserve the right to terminate or suspend your subscription at any time, with or without cause. If we terminate the service, you will receive a prorated refund for any unshipped boxes.
7.2 Customer's Right to Terminate: You may terminate this Agreement at any time by canceling your subscription in accordance with the cancellation policy outlined above.

8. Limitation of Liability

To the maximum extent permitted by law, Buckeye Brownies will not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to delays in shipping or unavailability of specific Limited Edition Flavors.

9. Governing Law

This Agreement is governed by and construed in accordance with the laws of the state in which Buckeye Brownies is headquartered, without regard to its conflict of law principles.

10. Entire Agreement

This Agreement constitutes the entire understanding between you and Buckeye Brownies regarding The Buckeye Club subscription service and supersedes all prior agreements, understandings, or representations.

11. Amendments

We reserve the right to modify these terms at any time. Any changes will be communicated to you via email or through our website and will become effective immediately upon posting. Your continued subscription constitutes acceptance of any such modifications.
